1) WHO WE ARE & SCOPE

Billionaire's Row NYC (“Company,” “We,” “Us,” or “Our”) operates billionairesrownyc.com and The Row Report (collectively, the “Services”), a private intelligence platform covering select supertall residential towers in Manhattan's 57th Street corridor, together with advertisements for real estate listings represented by Charles Fritschler, Our licensed broker (each, a “Company Listing”). This policy explains how We collect, use, disclose, and protect personal information in connection with the Services. Unless stated otherwise, We act as the business/data controller for information collected through the Services; some features rely on vetted third-party service providers acting on Our instructions.

2) CATEGORIES OF INFORMATION WE COLLECT

We may collect the following categories of information:

• Identifiers & contact: name, email, phone, mailing address, account credentials.
• Commercial/transaction: Row Report subscription and billing history, brokerage engagement and transaction records, and property inquiries.
• Content & communications: form submissions, survey responses, support or chat messages, and any documents You provide in connection with a transaction.
• Device/usage: IP address, device and browser information, pages viewed, links clicked, session duration, and approximate location.
• Cookies/advertising data: cookie identifiers, pixels, advertising identifiers, and stated preferences.
• Payment data: tokenized payment confirmations processed via Stripe; We do not store full card or bank account details.
• Social data: information You provide if You connect to Us via a social media platform.
• Sensitive data: We do not intentionally collect sensitive personal information and ask that You not submit it to Us unless necessary and lawful to do so.

3) HOW WE COLLECT IT

• Directly from You (forms, subscription checkout, chat, phone, SMS, or email).
• Automatically, via cookies, pixels, and similar technologies described in Section 4.
• From service providers (payment processing, analytics, messaging), advertising partners, and lawful public sources (e.g., public property records used to compile Row Report intelligence).

4) COOKIES & SIMILAR TECHNOLOGIES

We use cookies and similar technologies (“Cookies”) to operate the Site, remember preferences, secure sessions, analyze performance, and, where permitted, personalize advertising.

Categories We use:

• Strictly Necessary (always on): security, load balancing, login and session management.
• Functional/Preferences: remembers Your settings and preferences.
• Performance/Analytics: usage metrics and Site performance testing.
• Advertising/Targeting: used to deliver and measure advertising where permitted.
• Social Media: supports sharing and embedded content.

Managing Your choices:

• If You are located in the EEA or UK, We obtain opt-in consent for non-essential Cookies and provide a means to withdraw that consent at any time.
• If You are a California resident, You may opt out of the “sale” or “sharing” of Your information for cross-context advertising as described in Section 12. We honor Global Privacy Control (GPC) signals where technically supported.
• You may also block or clear Cookies using Your browser settings, though this may affect Site functionality.

5) HOW WE USE INFORMATION

We use information to:

• Provide, operate, and improve the Services, including compiling and maintaining The Row Report.
• Process Row Report subscriptions and, where applicable, facilitate real estate transactions and brokerage services You request from Charles Fritschler.
• Respond to inquiries and provide customer and subscriber support.
• Send transactional communications (receipts, renewal notices) and, with Your consent or as otherwise permitted by law, marketing communications by email, SMS, or advertising.
• Maintain security, prevent fraud or abuse, and comply with applicable law, including real estate license law recordkeeping obligations.
• Power certain AI-assisted features, as described in Section 6.

U.S. legal bases: as permitted by applicable law.

EEA/UK legal bases (where applicable): consent; contract performance; legitimate interests (e.g., security, Service improvement); legal obligation.

User Content: Photos, Video, and Testimonials

If You submit photographs, video, audio, written testimonials, or similar content (“Content”) to Us, We will use that Content only for the specific purpose You provided it (for example, responding to a support request or completing a specific engagement) unless You give Us Your separate, specific written consent to use it for marketing, advertising, or publication. Any such consent will describe the intended use and may be withdrawn prospectively at any time by emailing legal@billionairesrownyc.com; withdrawal will not require Us to remove Content already published where doing so is not reasonably practicable, but We will stop any new use going forward. If You are under the age of majority in Your jurisdiction, a parent or guardian must provide any such consent on Your behalf.

6) AI & MODEL-TRAINING CLAUSE

We use artificial intelligence as a core part of how the Services are built and operated, including to compile, cross-reference, and analyze public records and third-party data into the building- and market-level intelligence featured in The Row Report, as well as to support customer service, content drafting, and internal analytics.

What may be used: text You submit to Us (e.g., forms, chat messages), usage and engagement signals, and de-identified or aggregated analytics. We do not use full payment details, government identification numbers, or biometric data to train any model.

Purposes: to provide the features You request, and to improve the quality, accuracy, and safety of Our AI-assisted tools and analysis.

Your options:

• Opt out of training use: email legal@billionairesrownyc.com with the subject line “AI Training Opt-Out” to request that Your personal information (beyond de-identified or aggregated data) not be used to train Our or Our vendors' models.
• Enterprise or brokerage clients: at Your request, We will contractually restrict training use of Your data and pass through that restriction to Our vendors where feasible.
• If You are located in the EEA or UK, We rely on Your consent to use personal data to train models; You may decline or withdraw that consent without affecting Your access to the non-AI portions of the Services.

7) DISCLOSURES OF INFORMATION

We disclose information to:

• Service providers and processors (hosting, CRM and automation, messaging, analytics, Stripe for payment processing, customer support, and security).
• Advertising and marketing partners, to measure and improve campaigns or deliver targeted advertising where permitted.
• Other parties to a real estate transaction (e.g., cooperating brokers, title companies, attorneys, and lenders), but only where You have engaged Charles Fritschler for brokerage services and only as needed to complete that transaction.
• Successors in a corporate transaction (e.g., a merger, acquisition, or the transfer of the Services to a successor entity, as described in Our Terms and Conditions).
• Others where required for legal or safety purposes, or with Your direction or consent.

We do not sell personal information for money. Certain advertising-technology disclosures may be considered a “share” under the California Consumer Privacy Act as amended by the CPRA; see Section 12 for how to opt out.

8) COMMUNICATIONS CONSENT (TCPA/CTIA)

By providing a phone number or submitting Our forms, You agree that Billionaire's Row NYC (and service providers acting on Our behalf) may contact You with marketing, transactional, and informational messages related to Our real estate intelligence and brokerage services via SMS/MMS, phone calls, and, where permitted, prerecorded or automated messages. Consent is not a condition of purchase or subscription. Message and data rates may apply, and frequency will vary. You may opt out of SMS at any time by replying STOP (You will receive a one-time confirmation) and may request help by replying HELP. You may revoke consent to calls or voicemail at any time by emailing legal@billionairesrownyc.com. If You consent to be contacted, that consent applies even if Your number is registered on a federal or state Do-Not-Call list. You represent that You are at least 18 years old and are the account holder or authorized user of the phone number You provide.

9) RETENTION

We keep personal information only as long as necessary for the purposes described above, to operate the Services, and to comply with applicable law, including real estate broker recordkeeping requirements under New York and Florida law, tax and audit requirements, and to resolve disputes and enforce Our agreements. We then delete or de-identify the information under Our internal retention practices.

10) SECURITY

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information We hold. No system is completely secure. Please use a strong, unique password for Your account and contact Us immediately at legal@billionairesrownyc.com if You suspect unauthorized access.

11) CHILDREN

The Services are not directed to, and may not be accessed by, anyone under 18 years of age, consistent with Our Terms and Conditions. We do not knowingly collect personal information from anyone under 18. If You believe We have done so, contact Us at legal@billionairesrownyc.com and We will delete it.

12) U.S. STATE PRIVACY RIGHTS (INCLUDING CALIFORNIA CPRA)

Depending on where You live (for example, California, Colorado, Connecticut, Virginia, Utah, and other states with comprehensive privacy laws), You may have the right to access, delete, or correct Your personal information, to opt out of targeted advertising or the “sale” or “sharing” of Your information, to data portability, and to appeal a denied request.

California (CPRA): You may request:

• The categories or specific pieces of personal information We have collected about You;
• Deletion of Your personal information;
• Correction of inaccurate personal information; and
• To opt out of any “sale” or “sharing” of Your information for cross-context advertising.

How to exercise Your rights: email legal@billionairesrownyc.com. We may need to verify Your identity before fulfilling a request and will accept requests from an authorized agent with proof of authority. We will not discriminate against You for exercising any of these rights. We honor Global Privacy Control (GPC) signals as an opt-out of sale/sharing where technically recognized.

13) INTERNATIONAL DATA TRANSFERS

Your information may be processed in the United States, which may have different data protection laws than the country in which You reside. Where required by applicable law, We use appropriate safeguards for any such transfer, such as standard contractual clauses.

14) INTERNATIONAL VISITORS (EEA/UK)

If You are located in the European Economic Area or United Kingdom, We will honor requests to access, correct, delete, or restrict the processing of Your personal information, to object to certain processing, and to withdraw any consent You have given (for example, for marketing communications or the use of Your data described in Section 6), to the same extent required under the GDPR or UK GDPR. To exercise these rights, email legal@billionairesrownyc.com; We aim to respond within one month. Because Our Services are directed primarily at United States real estate transactions, We have not appointed a formal Article 27 EU or UK representative or a data protection officer at this time. If Our processing activities expand such that one becomes required, We will update this policy and appoint one accordingly. You may also lodge a complaint with Your local supervisory authority or the UK Information Commissioner's Office.

15) THIRD-PARTY LINKS & SOCIAL FEATURES

The Services may link to third-party sites or include social media plugins or embedded content. We are not responsible for the privacy practices of those third parties; please review their policies directly.

16) CHANGES TO THIS POLICY

We may update this policy from time to time. We will revise the “Last Updated” date above and, where legally required, notify You or seek Your consent before any material change takes effect.
